These questions are common among residents already residing in a property within the Association.

Why do we have a homeowners association?

When our residences were built back in the 80s, the builder established the association. This association is responsible for the  

  • maintenance of the retention basins on Burkwood Dr and Mt. Royal. Note: We are only responsible for the larger basin on Mt. Royal. Dues cover the following:
    • Insurance
    • Maintenance (mowing/trimming)
    • Website (Domain, Microsoft 365)
    • Attorney Fees for dues collection (in the past, now omitted) or liens
    • Articles of Incorporation 
    • Postage
    • Miscellaneous 

I rent my house to someone else. Do I still owe association dues?

Yes. The association dues are associated with the house. Letters are mailed to the residence. If you rent your house to someone else and do not reside on the property, it is your responsibility to reach out to the Association to make sure you receive a copy of the annual Association Dues letter. 

I don't want to be part of an association and I don't want to pay. Can I op

No. All properties that have been deemed part of the Association are responsible for paying their dues. 

How do I pay my association dues?

Who do I make my check out to?

Bayberry Trails Homeowners Association. Note: Checks and money orders made payable to the association attorney will be returned as we are unable to cash these checks!

Why can't I send payment to the Association attorney?

To simplify the collection process and omit the use of third-party collection. 

I'm delinquent. What does this mean and how can I become current?

Property owners with delinquent dues are at risk as the Association can place a lien on the property. If you are delinquent, please contact the Association President to make arrangements for bringing your account current.  

There are more than 60 houses in this neighborhood. Don't they pay dues?

The neighborhood is divided out into association sections. Each section is responsible for specific retention basins. Our association is only responsible for the collection of due for those properties under Section 3A-3C. We are responsible for the basin on Burkwood as well as the larger basin on Mt. Royal.  

Why aren't all retention basin lots kept maintained?

Unfortunately, the Bayberry Trails Homeowners Association has no way of knowing who is responsible for the maintenance of the other retention basins within our neighborhood. If you see an unkempt basin, feel free to contact the City of Clayton as city ordinances do apply.

New/Potential Homeowners & Title Companies

These questions are common for those looking to move into the neighborhood.

I just bought this house and found out it's part of an association. Help!

Don't panic. We're pretty easy going. This association is not going to be a massive thorn in your side. Our dues are annual and inexpensive (we're talking tens of dollars, not hundreds or thousands). 

What is this homeowners association all about?

Do homeowners have restrictions outlined by the Association?

No. Our association does not care what you do to your property--that's between you and the City of Clayton. Our only concern is whether or not your dues have been paid. 

Why didn't you tell me I was part of an association?

This is a fairly common complaint among new homeowners within our association. However, the Association has no way of knowing when a property is being sold, and current homeowners are under no obligation to inform us. 


All potential homeowners should work with their real estate agent, as well as their title company and financial institution, to determine if a property is listed within a homeowner's association. 

Why am I getting a bill for the previous owner's delinquent association due

The Association assesses dues as outlined by the bylaws. These dues are tied to the property. If you have purchased a new home within the association and have received a letter of delinquency, please contact the Association President. 

Who is responsible for paying association dues?

This is between the seller and the potential buyer. When a property is being sold, sellers will often pay the association fee up front as part of the closing. However, this is NOT required by the Association--the Association bills homeowners for dues based on the property address, nothing more.
